Terms and Conditions – Clothing Rental

These Terms and Conditions apply to all rental agreements concluded with Bjorn Lanen Private Gallery, operated by Bjorn van Lanen, located at Hinthamerstraat 140A, 5211 MT, ’s-Hertogenbosch, The Netherlands.
By requesting and confirming a rental, the customer agrees to these Terms and Conditions.
1. Definitions

Lessor / We / Us: Bjorn van Lanen, trading as Bjorn Lanen Private Gallery.

Customer / Renter / You: The natural person or legal entity requesting and entering into a rental agreement.

Garment(s): The clothing item(s) offered for rent.

Rental Period: The agreed period during which the garment is rented.
2. Applicability
2.1 These Terms and Conditions apply to all rental agreements concluded via email or other written communication.
2.2 Deviations from these Terms are only valid if agreed in writing.
3. Rental Request and Agreement Formation
3.1 To request a rental, the customer must contact us via email and provide:

Full name and address

Selected garment(s)

Desired rental period
3.2 All rental requests are reviewed individually.
3.3 The customer will receive a response within approximately 24 hours confirming:

Availability
-
Rental price
-
Security deposit (if applicable)

Payment instructions

Further rental details
3.4 A rental agreement is only concluded once:

The rental price and conditions have been confirmed in writing; and

The customer has accepted the offer and completed the required payment.
4. Rental Period
4.1 The standard rental period is 7 days, including weekends, unless otherwise agreed in writing.
4.2 The rental period begins on the agreed start date as confirmed in writing.
4.3 The garment(s) must be returned not later than the agreed end date, regardless of the shipping method used.
4.4 Extension of the rental period is only possible upon prior written approval.
4.5 If the garment is returned late without prior written approval, the rental fee for the product will automatically be doubled each week.
5. Rental Price and Security Deposit
5.1 The rental price is communicated to the customer by email after the rental request has been reviewed. The price is determined based on the selected garment(s) and rental period.
5.2 A security deposit may apply and will be clearly stated in the written offer.
5.3 The security deposit must be paid before the start of the rental period.
5.4 The deposit will be refunded within 7 business days after the garment has been returned in correct and damage-free condition.
6. Payment
6.1 Payment must be completed according to the payment instructions provided in the confirmation email.
6.2 By completing the payment, the customer authorizes Bjorn Lanen Private Gallery to charge:

The rental price;
-
The security deposit;
-
Any additional costs resulting from damage, loss, theft, late return, or non-compliance with these terms.
6.3 If damage or replacement costs exceed the security deposit, the customer will receive an additional invoice payable within 14 days.
7. Customer Responsibility
7.1 The customer is fully responsible for the garment during the entire rental period.
7.2 Responsibility includes, but is not limited to:

Damage
-
Stains
-
Loss
-
Theft
-
Unauthorized alterations
-
Excessive wear
7.3 The garment must be returned in the same condition as received.
7.4 If the garment is not returned in its original condition, the customer is liable for:
-
Repair costs; or the full replacement value of the garment, as determined by Bjorn Lanen Private Gallery.
8. Damage, Loss, or Theft
8.1 Repair costs will be deducted from the security deposit.
8.2 If repair is not possible, the full replacement value will be charged.
8.3 If costs exceed the security deposit, the remaining amount will be invoiced separately.
8.4 In case of loss (this also includes loss by postal or courier service) or theft, the customer is liable for the full replacement value.
9. Return Policy
9.1 The garment must be returned using the agreed return method.
9.2 The customer remains responsible for the garment until it has been received by us.
9.3 We strongly recommend using insured and trackable shipping.
10. Late Returns
10.1 Late returns without prior written approval will result in:

Doubling of the rental fee; and/or additional compensation if the delay causes loss of subsequent bookings.
11. Cancellation
11.1 Cancellation before shipment may be possible, subject to administrative costs.
11.2 Once the rental period has started or the garment has been shipped, cancellation is no longer possible.
12. Digital Agreement
12.1 Written confirmation by email, verbally agreed and payment of the rental fee constitutes a legally binding agreement.
12.2 Electronic communication has the same legal validity as a handwritten signature.
13. Liability
13.1 Bjorn Lanen Private Gallery is not liable for:

Improper use of the garment;

Allergic reactions;
-
Indirect or consequential damages;
-
Delays caused by postal or courier services.
13.2 Liability is limited to the rental amount paid, except in cases of intentional misconduct or gross negligence.
14. Governing Law and Jurisdiction
14.1 These Terms and Conditions are governed by law.
14.2 Any disputes shall be submitted to the competent court in the Netherlands.
